The site www.mineralbeautysystem.com is an online store operated by „BIO-ROM, Ltd“ (hereinafter referred to as „Bio Rom“) with the registered office at Racianska 71, SK-83102 Bratislava, which is works as our main trading address. The company is registered in Slovakia, regulated by the business law of the Slovak Republic, under company number 36366650 and the VAT number 2022204657.
These General Terms and Conditions (as amended) apply to the business relationships of any kind between „Bio Rom“ and the customer.
Bio Rom reserves the right to refuse to perform the service promised if it becomes apparent after concluding the Contract that the goods are not available although a corresponding contractual transaction has been already concluded. In such a case, the customer shall be notified immediately. Any considerations which have already been provided shall be reimbursed without delay. Further claims against Bio Rom are excluded.
All prices include VAT (where applicable) at the applicable current rate chargeable in the Slovakia for the time being. However, if the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the products in full before the change in VAT takes effect.
The Website contains a large number of products. It is always possible that, despite our reasonable efforts, some of the products on the Website may be incorrectly priced. If we discover an error in the price of the products you have ordered we will inform you of this error and we will give you the option of continuing to purchase the product at the correct price or cancelling your order. We will not process your order until we have your instructions. If we are unable to contact you using the contact details you provided during the order process, we will treat the order as cancelled and notify you in writing. Please note that if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the products to you at the incorrect (lower) price.
Any kind of payment must be made securely by one of the following payment methods, unless otherwise specified:
- Credit Card Transfer: major credit cards as listed: Visa, MasterCard, American Express, Maestro, and Visa Electron (processed immediately)
- Bank Transfer: SEPA bank transfer payments within the states of Eurozone (1-2 days to process).
Any date or period for delivery shall be considered as indicative only. It is our policy to try to despatch all orders within 3 working days. Any products not available at the time of your order will be sent to you, as soon as possible, when received from the supplier. In any case, delivery will be made within 30 days after the date we accept your order. If there are delays in the delivery caused by the supplier, the carrier or any other third party then Bio Rom will contact you as soon as possible to let you know and, provided we do this, we will not be liable for such delay. If there is a substantial delay you may end the contract using the procedure at clause „Statutory right of Withdrawal“ below and will be entitled to receive a refund for any products you have paid for but not received.
All the delivery prices are cash prices and include VAT plus any applicable charges for packaging and carriage.
The international shipping charges will be available under shipping tab in your shopping process. The shipping costs differ from country to country and will be calculated for you automatically. The standard shipping method is via the Slovak Post Office Service or GLS. Additional customs, duties and charges for deliveries to countries outside the EU (third countries) shall be borne by the customer.
The goods must be thoroughly inspected by the customer or an authorised individual upon receipt in order to detect any transportation damage.
The risk of accidental loss and accidental deterioration of the sold goods shall only pass to the customer upon handover of the item. Handover shall be deemed to have taken place even if the buyer delays in accepting the goods. Delivery shall be to the delivery address specified by the customer. The customer cannot claim for any compensation should he fail to take over the goods from the post office during the package held period.
Statutory right of withdrawal
The customer shall be entitled to withdraw from the contract within fourteen (14) days without giving any reason for doing so. The deadline for withdrawal shall be fourteen (14) days from the date on which the customer or a third party appointed by the customer, who is not the carrier, takes possession of the final goods delivered. Another reason for a withdrawal is, as mentioned in „Delivery“ in case, if there is a substantial delay. In both cases, you will be entitled to receive a refund for any products you have paid (and not received, received damaged or was not satisfied). In cases where the rejection of the goods is due to a defect or discrepancy in the order, the Customer is entitled to a full refund within 30 days of the date of delivery of the products.
In order to exercise the statutory right of withdrawal, the customer must notify us (BIO-ROM, Ltd, Racianska 71, SK-83102 Bratislava, tel.: +421 2 44 373 707, email: firstname.lastname@example.org) of his/her decision to withdraw from this Contract in a clear declaration (e.g. by sending a letter by mail, E-Mail or fax).
If the customer withdraws from this Contract, we must reimburse any payments we have received from the customer, including delivery costs (excluding any additional costs incurred if the customer has selected a different type of delivery to the cheapest standard delivery option offered by us) without delay, but no later than fourteen (14) days after the day on which we receive the notice of the customer’s withdrawal from this Contract. We will use the same payment method the customer used for the original transaction in order to provide the reimbursement, unless otherwise expressly agreed; under no circumstances will the customer be charged a fee for this refund. In the case of withdrawal after returning already received product that was not damaged (e.g. wrong ordered product) or delayed, we are not obligated to cover the delivery costs and may withhold the reimbursement until we have received the returned goods.
If the goods are to be rejected in any other way that was mentioned before in the „Statutory right of Withdrawal“, the Customer shall comply with the return procedure as defined in this clause. Bio Rom will not accept any returned goods should the return not follow the aforementioned return procedure.
In cases where you wish to cancel due to something we have done or are going to do, you should notify us in accordance with our returns procedure and we will refund you in full for any products not provided (including delivery costs). You may also be entitled to compensation. This includes the following:
- Bio Rom have told you about an upcoming change to the product or these terms which you don’t agree to;
- Bio Rom have told you about an error in the price or description or the product and you don’t want to proceed;
- Delivery of the products has been substantially delayed by an event outside of our control;
In any case of a dissatisfaction, please contact us at email@example.com and we will gladly follow you through your cancellation or return.
Where the Customer wishes to return a Product it must either return them in person, post them back to Bio Rom or (only if they are not suitable for posting) allow us to collect them from you. Where you are returning products pursuant to the case in which we are obligated to cover the cost of shipping, then we will pay the costs of postage or collection.
